I - Privacy and the Protection of Personal Data
The privacy and protection of the personal data of all customers and users of the services provided by IMEG, LDA, with registered office at Rua do Casaca nº 6, 4705-629 Sequeira, Braga, Portugal, with VAT number 508 177 766 at all times, is an essential aspect of the way it operates and organises itself.
IMEG, LDA thus aims to ensure that all its Clients are aware, at all times, of the rules and principles relating to the protection and processing of personal data, making every possible effort to ensure the security of this data, in accordance with the rules and procedures defined in the applicable legislation, namely the Personal Data Protection Act (Act no. 67/98, 26 October).
In this way, the company adopts the best technical and organisational practices to protect customers' personal data against loss, unintentional or unlawful deletion and improper alteration, as well as against breaches of integrity, unauthorised access or disclosure.
On the IMEG, LDA website you may find links to other websites that are unrelated to our company. The provision of such links is made in good faith and IMEG, LDA cannot be held responsible for the collection and processing of personal data carried out on these websites, nor can it be held responsible for the accuracy, credibility and functionality of websites belonging to third parties. Therefore, the provision of links to other websites outside IMEG, LDA does not imply any assumption of responsibility in relation to them, and consequently this Privacy Policy does not apply to them.
IMEG, LDA also recommends that its Clients adopt complementary security measures, including keeping equipment and programmes properly updated and configured, using protection against malicious software and firewalls, and not browsing websites for which there is no guarantee of authenticity.
You are advised to carefully read this Privacy Policy, the Acceptable Use Policy (AUP), the General Conditions for the Provision of Services, as well as the Terms and Conditions for each of the services provided by the company.
This Privacy Policy may be amended or revised at any time, and any amendments or revisions will be duly publicised and communicated on the IMEG, LDA website.
II - What is Personal Data?
Personal data is information of any nature and regardless of its medium, including sound and image, relating to an identified or identifiable natural person. An identifiable person is one who can be identified directly and indirectly, in particular by reference to an identification number or to one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity.
III - Responsible for the Collection and Processing of Personal Data
IMEG, LDA is responsible for the collection and processing of Customers' personal data, under the terms of paragraph d) of article 3 of Law no. 67/98, 26 October, and it is up to the latter to decide, in the context of the provision of Services to the Customer, which personal data is collected, the means of processing the data and the purposes for which it is used.
IV - Liability for data communicated to third parties
IMEG, LDA may, in the course of its business and within the scope of the Services it provides, subcontract third parties for the purposes mentioned above and for the development and management of its services, which may imply access by these entities to the personal data of its Customers. When this happens, IMEG, LDA takes the appropriate measures to ensure that the entities that will have access to the data offer the highest technical, organisational and human guarantees at this level.
Therefore, third parties subcontracted by IMEG, LDA will be obliged, under the terms of the law, as well as by virtue of an agreement signed with the former, to implement appropriate technical and organisational measures to protect personal data against accidental or unlawful destruction, dissemination, alteration, disclosure, unauthorised access and against any other form of unlawful processing, as well as being bound by special duties of professional secrecy and confidentiality.
Apart from these cases, IMEG, LDA will only pass on its Customers' personal data to third parties when:
a) it is obliged to do so by virtue of a legal provision and only to the strict extent of its obligations or,
b) in cases where the law expressly allows it, if the Customer expressly and specifically authorises such transmission and is duly informed, in writing, of the recipients of the personal data and the purposes of the data transmitted.
In any case, IMEG, LDA remains responsible for the personal data provided by Customers.
The provision of certain services by IMEG, LDA may involve the transfer of your personal data outside of Portugal. In such a case, the company declares that it will strictly comply with the determination of the suitability of the country of destination of the information with regard to the protection of personal data and the requirements applicable to such transfers, under the terms of the law.
V - Conditions for the Collection of Personal Data
IMEG, LDA only collects and processes Customers' personal data with their express consent, in accordance with each of the specific purposes of the processing in question, under the terms of the Personal Data Protection Act.
Clients may withdraw their consent at any time, free of charge.
There are, however, personal data that are indispensable to the provision of Services by IMEG, LDA, (obligatory data), and Clients are duly and previously informed of this need and of the consequences of not providing said data.
If the personal data considered indispensable is not provided by Customers or proves to be insufficient, incorrect or out of date, IMEG, LDA will not be able to provide the Service(s) subscribed to, in which case Customers will assume full and exclusive responsibility for the insufficiency or incorrectness of the data transmitted.
VI - Personal Data Retention Period
IMEG, LDA will only keep Customers' personal data for the period of time strictly necessary to allow:
a) the provision of the Service(s);
b) the fulfilment of the legal obligations to which IMEG, LDA is bound;
c) the fulfilment of the purposes of collection and/or processing;
d) the exercise of Clients rights and the fulfilment of the corresponding obligations.
In cases where the National Commission for the Protection of Personal Data (CNPD) authorises the retention of personal data of Customers for periods longer than the duration of the service contract, in view of the specific purpose of the processing in question, the Customer will be duly informed in good time of this purpose and of the retention period in question.
After the retention/saving period has elapsed, under the terms set out above, the Customers personal data will be permanently deleted by IMEG, LDA
VI - Customers rights with regard to their personal data
In accordance with the provisions of the Personal Data Protection Act, the Customer is guaranteed the right to access, correct, update and delete their personal data free of charge.
In any of the above cases, the Customer may exercise their legitimate rights by sending a written communication to the email address geral@imeg.pt, addressed to the Personal Data Protection Officer.
VII - Unsolicited electronic communications for direct marketing purposes
The contact details of the Customer, who is a singular person, may be used by IMEG, LDA, if the Customer expressly authorises it, in direct marketing actions and promotion of services provided by IMEG, LDA, under the terms of article 13 of Law no. 41/2004, of 18 August, in the version conferred by Law no. 46/2012, of 29 August.
In the case of a Customer who is a legal person, IMEG, LDA may send unsolicited communications for direct marketing purposes relating to goods and services provided by itself or by a company in the same Group, unless the Customer expressly refuses to receive this type of communication in the future and registers on the national list of legal persons who expressly object to receiving unsolicited communications for direct marketing purposes, which the Directorate-General for Consumer Affairs (DGC) is responsible for keeping up to date.
In any of the aforementioned cases, the Customer shall have the right to expressly oppose, free of charge, via e-mail, the sending by IMEG, LDA of electronic communications for direct marketing purposes. The Customer may thus exercise his/her legitimate rights by sending a written communication to the e-mail address geral@imeg.pt, addressed to the Personal Data Protection Officer.

IX - Security measures adopted to protect personal data
Within its organisational structure, IMEG, LDA has a Data Protection Officer, who is responsible for implementing and complying with the legal and regulatory rules applicable to the processing of personal data and who is responsible in particular for maintaining and developing the Security, Confidentiality, Secrecy and Protection of Personal Data Policy.
X - Procedural Measures and Security Techniques
IMEG, LDA applies the necessary technical and organisational measures to ensure that, by default, only the personal data of Clients necessary for each specific processing purpose is processed, and these are reviewed and updated periodically by the department responsible.
IMEG, LDA has also implemented sufficient, necessary and appropriate technical, physical, organisational and security measures to protect personal data against accidental or unlawful destruction, accidental loss, alteration, disclosure, unauthorised access and against any other form of unlawful processing.
IMEG, LDA has therefore adopted different security mechanisms and procedures, following best practices in terms of information security in the systems that support the services it provides and that store clients' procedural data, namely the use of firewalls and intrusion detection systems, the existence of restricted access - physical and logical - the recording of operations (logging) and respective monitoring and auditing, the collection and transmission of personal data by secure means.
The personal data collected by IMEG, LDA is stored securely in the company's systems which, in turn, are located in the company's own datacentre under cover of all the physical and logical security measures that are essential for the protection of personal data.
Whenever it is necessary to communicate personal data of its Customers to Third Parties, IMEG, LDA will be responsible for the personal data in question and guarantees that:
a) the sharing of personal information complies with the legal regulations in force;
b) the transmission is carried out securely, namely through the use of encryption protocols and,
c) Third parties are contractually obliged to observe the duties of confidentiality and secrecy and to ensure the security of personal data communicated to them for this purpose, and may not use such data for any other purpose, for their own benefit or for the benefit of third parties, or correlate it with other data available to them.
